These Terms of Service (“Terms”) govern your use of the Husker Horticulture website and any request for, purchase of, or receipt of services from Husker Horticulture (“Husker Horticulture,” “we,” “us,” or “our”). By using our website or engaging our services, you agree to these Terms.

If you do not agree, do not use our website or services.

1) Services

Husker Horticulture provides landscaping and property maintenance services that may include (depending on your agreement): mowing and maintenance, cleanups, fertilization programs, turf restoration, landscape design and installation, and seasonal services such as snow and ice management (“Services”).

Specific scope, pricing, frequency, and exclusions will be defined in your estimate, proposal, work order, or service agreement (each, a “Service Agreement”). If there is a conflict between these Terms and a Service Agreement, the Service Agreement controls for that project.

2) Estimates, proposals, and changes

Estimates: Estimates are based on visible site conditions and information provided at the time of quoting.

Changes: Any work not included in the Service Agreement (including “while you’re here” requests) requires approval and may result in additional charges.

Substitutions: If specified materials (plants/products) are unavailable, we may propose substitutions of comparable type/quality.

3) Scheduling, access, and site conditions

Access: You agree to provide safe and reasonable access to the property and work areas during scheduled service windows (including unlocked gates when needed).

Obstacles: Please remove pet waste, toys, hoses, debris, and vehicles from service areas prior to scheduled visits when possible.

Utilities and hidden conditions: You are responsible for identifying private utilities (e.g., invisible dog fences, sprinkler lines not disclosed, landscape lighting wiring) and marking hazards. We are not responsible for damage caused by undisclosed or unmarked underground items or hidden conditions.

4) Weather and seasonal conditions

Many Services depend on weather, soil conditions, and seasonal timing. We may reschedule or modify timing for safety and quality reasons due to rain, snow, frost, extreme heat, or saturated soils. Service timing is not guaranteed to a specific hour unless explicitly agreed in writing.

5) Customer responsibilities (pets, safety, and property)

Keep pets secured during service visits.

Maintain safe conditions and remove hazards when possible.

You are responsible for informing us of known site risks (bees/wasps, aggressive animals, hazardous materials, etc.).

6) Pricing, invoices, and payment terms

Fees: Service fees and billing frequency are stated in the Service Agreement.

Payment timing: Payment is due according to the invoice terms shown on your invoice (e.g., due upon receipt or net X days).

Late payments: Late payments may be subject to a late fee and/or service suspension until the account is current.

Collections: You may be responsible for reasonable costs of collection for overdue balances, where permitted.

7) Cancellations, pauses, and termination

One-time projects: Cancellations may be subject to charges for materials ordered, prep work completed, or scheduling time reserved.

Recurring services: You may request to pause or cancel recurring services with reasonable notice.

Our right to suspend/terminate: We may suspend or terminate services for non-payment, unsafe conditions, repeated access issues, harassment of staff, or other material breach of these Terms.

8) Satisfaction, warranties, and results

Workmanship: We aim to perform services professionally and in a workmanlike manner.

No guarantee of specific outcomes: Landscaping results vary due to weather, soil, irrigation practices, pests, disease, shade/sun exposure, and other factors beyond our control. We cannot guarantee specific turf/plant outcomes unless explicitly stated in writing.

9) Property damage and limitations

Reasonable care: We use reasonable care to avoid damage.

Normal risks: Some incidental impact may occur during landscaping work depending on site conditions.

Reporting: Please report any claimed damage within a reasonable time after service (recommended: within 48 hours) so we can inspect promptly.

10) Limitation of liability

To the maximum extent permitted by law:

Husker Horticulture will not be liable for indirect, incidental, special, consequential, or punitive damages.​

Our total liability for any claim related to the Services or website will not exceed the amount you paid us for the specific Service giving rise to the claim.​

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11) Website use (acceptable use)

You agree not to misuse our website, including by attempting to gain unauthorized access, disrupting site functionality, scraping content at scale, or introducing malware.

12) Intellectual property

All content on this website (text, images, branding, logos) is owned by Husker Horticulture or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute it without written permission.

13) Privacy

14) Communications and SMS

If you provide your phone number, you consent to receive calls and texts related to scheduling, estimates, service updates, and billing. Message/data rates may apply. You can opt out of SMS at any time by replying STOP (where applicable).

SMS Terms & Opt-Out Policy

You can cancel SMS messages from Husker Horticulture at any time. Simply reply STOP to any message from us. Once we receive your STOP request, we'll send a final confirmation and you'll be removed from our list immediately — no further messages will be sent.

15) Governing law and disputes

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. (Governing law clauses are standard in terms and agreements.)

16) Changes to these Terms

We may update these Terms from time to time by posting a new “Last updated” date on this page. Modification clauses are standard in terms and conditions.
